The Chinese Government through its ruling Communist Party has decided to build a seven storey headquarters for the ruling All People Congress Party, violating international as well as Sierra Leone laws.
Chapter I, Article 2, paragraph 7 of the United Nations Charter has certainly not authorized signatories of member states “to intervene in matters which are essentially within the domestic jurisdiction of any state.”
The only exception to non-intervention principle is but in Chapter VII, which authorizes the United Nations to intervene against “the existence of any threat to peace, breach of peace, or act of aggression.”
The aforementioned no doubt reveals how China’s gesture in the construction of a seven storey political headquarters for the ruling APC party violates United Nations Charter, and by extension an indication that the Chinese Government is seemingly but slowly interfering into the politics of Sierra Leone.
It also puts the 2018 elections that the issue of ‘elections hacking’ which recently has become a serious problem for sophisticated countries like the Unites States and France is little by little being imported into Sierra Leone, which up until now has got no serious cyber security laws.
Locally, the ruling APC under the Chairmanship of President Koroma is the custodian of the laws of Sierra Leone, but has violated section 19 sub section 1 of the Political Parties Registration Act 2002, which clearly states:
“the source of fund of a political party shall be limited to contributions or donations, whether in cash or in kind of persons who are entitled to be registered as voters in Sierra Leone”
Knowingly or unknowingly, the APC of President Koroma has violated the laws of Sierra Leone just when State House Communication department reported that ‘President Koroma alluded to the fact that the said party office is being built by the Chinese.
The report further said, “the APC party has had established relationship with the Chinese, and has in no time limited China’s help to Sierra Leone to APC alone.”
Many say however that the kind but questioned gesture by the Communist Party of China to construct a seven storey building for the APC depicts the fact that the action of President Koroma and his ruling party is but not only immoral, but one utterly unlawful.
Governance experts have said that the reason behind the construction of a seven storey building for a political party in a third world country like Sierra Leone and from China’s ruling CPC party is suspicious and must be investigated to find out the real motive behind it.
Others adamantly say “China’s willingness to freely construct a seven storey building for the ruling APC party at a time the country is preparing for elections is an indication of Chinese government’s interference into the politics of Sierra Leone.
“There must be some deals that are playing underground. This is the first time that a political party in another country is building office for a party in another country,” one expert said.
Of course, opposition politician and Leader of the Alliance Democratic Party (ADP), Mohamed Kamarainba Mansaray has described the construction of a seven storey building for the ruling APC as ‘political corruption’ and of course a ‘conspiracy’ in exchange for the avalanche of contracts to the Chinese.
Reference must also be drawn to President Koroma’s sacking of his elected Vice President Chief Samuel Sam Sumana, which regretfully has seen the Sierra Leone government dragged to the ECOWAS court for alleged constitutional violations.
That the political parties act 2002 was established by parliament for the registration and regulation of the conduct of political parties in accordance with sections 34 and 35 of the constitution and to provide for related matters.
That a violation of any of its law is no doubt equally an abuse of the Sierra Leone 1991 constitution, the highest law of the land.
They say the land on which the seven storey building is to be built is a subject of Appeal’s court hearing subsequent to a ruling at the High Court that the land is property of one Haja Aminata Conteh, a popular cookery seller at Percival Street Freetown.
It was even ruled that the second garnishee do pay to the judgement creditor (Haja Aminata Conteh) twenty one million three and fifty thousand four hundred leones being solicitor’s taxed costs as ordered by the Supreme Court of Sierra Leone.
